"In the most important Treaty of the European Community, namely the Treaty establishing the European Community, Article 23 states that the Community shall be based upon a customs union. The fundamental meaning attributable to Article 23 does not only emerge from the wording of the aforementioned Article, but also from a systematic interpretation of the Treaty. Article 23 EC is at the beginning of part three of the Treaty, where one finds the regulations about fundamental freedoms, and the first of it concerning the free movement of goods. According to this interpretation the Customs Union is a fundamental tenet of the Community’s free movement of goods. And in turn the free movement of goods is the main instrument used to establish the European common market, the main goal for creating the Community."Bartosz Makowicz
